Drug intel leads to arrests

Drug intelligence reported to the Hillsboro Police Department on Sunday led to a total of three men being arrested.

According to an affidavit filed with the Hillsboro Municipal Court, the HPD received a tip alleging that multiple males were using drugs behind a shed on a property in the 700 block of North West Street.

Upon arrival, the officer reported that he made contact with three males. One of them – identified as Larry Hutton, 19, Hillsboro – allegedly “drop(ped) a syringe, a clear round plastic baggie, and two cigarettes on the ground,” according to the affidavit.

All three were ordered to the ground and detained. The other two were identified as David Tolliver, 20, Hillsboro, and Nikolaus Rossman Jr., 21, Seaman.

When asked, Rossman allegedly said that he had a needle in his left front pocket, which was reportedly removed by the officer.

The affidavit added that Tolliver was then asked where his syringe was. He allegedly “stated that his was in the chair and must have fallen on the ground when the officer made contact with them,” according to the affidavit.

The officer reported that Hutton was asked if he had anything on him. He allegedly said that he had a small bag of marijuana in his front right pocket. The affidavit stated that the officer located that bag, along with a razor blade and a lighter.

All three were then transported to the Highland County Justice Center.

The affidavit added that during intake a plastic wrapper containing five unknown prescription pills was allegedly located on Tolliver. The pills were reportedly later identified as four oxycodone pills and one morphine tablet.

All three suspects appeared in the Hillsboro Municipal Court on Monday.

Hutton faces a fifth-degree felony charge for drug abuse, according to court records. He is also charged with second-degree misdemeanor possession of drug abuse instruments.

Hutton’s bond is set at $25,000 on a pending charge for possession of drug abuse instruments from earlier this year. Records showed that sentencing was deferred until December in that case. According to records, that charge would have been dismissed if there were no additoinal issues and if Hutton completed counseling and had no contact with a reportedly involved party.

A preliminary hearing and a pretrial on Hutton’s new charges are set for Aug. 13. He is ordered to have no contact with the reportedly involved property or with his co-defendants. If Hutton posts his bond, he will be under a curfew. He must also report to the probation department.

Tolliver also faces a fifth-degree felony for drug abuse, as well as a misdemeanor charge for possession of drug abuse instruments. A $25,000 bond is set on the misdemeanor, records showed. He must have no contact with his co-defendants, observe a curfew, and report to the probation department. Tolliver’s preliminary hearing and pretrial are also set for Aug. 13.

Rossman’s bond was set at his own recognizance (OR). According to records, he is scheduled for a deferred sentencing in October.

He must have no contact with Hutton or Tolliver, observe a curfew, enroll in substance abuse counseling, report to the probation department, and complete 50 hours of community service.
