A Leesburg man who is reportedly a suspect in a Fayette County car theft was arrested outside of Rainsboro over the weekend.

An affidavit filed with the Hillsboro Municipal Court stated that the Highland County Sheriff’s Office and other county agencies received information from Fayette County on Saturday morning concerning a stolen 2004 Pontiac Grand AM, maroon in color.

While on patrol, a deputy reportedly came to the intersection of SR 753 and U.S. Route 50, where he had a clear view of the Rainsboro 1st Stop. There, he allegedly “observed a vehicle matching the description of said stolen vehicle pulling away from a fuel pump,” according to the affidavit.

The deputy reported that “the suspect vehicle then noticed (him) stopped at the intersection and crossed U.S. 50, traveling northbound on SR 753,” as stated in the affidavit.

The affidavit added that the deputy followed the vehicle, activating his overhead lights and siren. The vehicle allegedly “accelerated at a high rate of speed, pulling away from (the) patrol car,” the affidavit stated.

The vehicle later pulled over. When the deputy told the driver to exit, walk to the rear of the vehicle, and lay on the ground, the driver reportedly complied.

The driver was identified as Seth M. Smith, 25. According to the affidavit, Smith was “the suspect believed to be involved in the theft of the vehicle from Fayette County.”

The affidavit added that a teenager was also in the vehicle at the time of Saturday’s alleged incident.

Smith is charged with receiving stolen property, a fourth-degree felony; failure to comply with an officer and theft, both first-degree misdemeanors; and driving under a suspension, an unclassified misdemeanor.

A preliminary hearing is set for Aug. 27. Pretrials on Smith’s misdemeanor charges are also scheduled for that time.

According to court records, Smith has a holder out of the Adult Parole Authority (APA). He is currently under supervision on Fayette County convictions for burglary and intimidating a victim/witness, both third-degree felonies, according to the Ohio Department of Rehabilitation and Correction.

After Smith’s APA holder is dropped, he will be on a $10,000 bond, court records added.

If Smith posts his bond, he must report to the probation department and observe a curfew. He is also prohibited from driving.

While his case is pending, he is to have no contact with reportedly involved parties or the Rainsboro 1st Stop.
