Three defendants heading to prison

Three defendants in separate cases this week are heading to prison, two after admitting to charges and the third after admitting to violating community control.

Michael Alan Robertson, 27, Leesburg, was sentenced to a total of four years in prison after pleading guilty to three counts of heroin trafficking, all fifth-degree felonies, and one count of third-degree felony having weapons while under disability.

He was sentenced to eight months in prison on each of the trafficking charges and to 24 months in prison on the third-degree felony. All of the sentences were ordered to run consecutively.

Lula Spruance, 40, Hillsboro, admitted to violating her community control and was sentenced to serve a total of 36 months in prison on three counts of fourth-degree felony aggravated trafficking in methamphetamine and one count of fifth-degree felony heroin possession.

She was initially sentenced to community control and treatment in May 2015 after pleading guilty to the charges. Probation violations about a year ago resulted in an order to complete residential treatment.

This week the violations she admitted to included failing to report multiple times, consuming methamphetamine, and failing to pay on restitution.

David Willett, 48, Greenfield, was sentenced to seven months in prison on one count of heroin possession, a fifth-degree felony. He pled guilty to the charge earlier this month.

In other hearings, Craig Dawson, 50, Loveland, admitted to violating his community control, but he will not be sentenced until January.

Dawson admitted to failing to report, not reporting contact with law enforcement, and not meeting his monthly obligations in child support.

Dawson initially pled guilty to fifth-degree felony nonsupport and was sentenced to five years community control in May 2013.

Emily N. Smith, 40, Hillsboro, admitted to being convicted in Hillsboro Municipal Court for driving under suspension, failing to report to probation, and failing to complete a previously ordered treatment program.

Smith was initially admitted into the prosecutor’s diversion program in 2013 after pleading guilty to fifth-degree felony receiving stolen property. She was later terminated from the program after admitting to violations and was placed on community control and ordered to complete treatment.

On Wednesday, she was continued on community control and ordered to complete the STAR residential treatment program as well as additional treatment afterward.
