Six indicted by grand jury

A Leesburg man indicted on multiple trafficking and possession charges was among six people indicted in Highland County Common Pleas Court by a grand jury.

Preston Cress, 34, was indicted on one count of trafficking in a fentanyl-related compound, a first-degree felony, possession of a fentanyl-related compound, a first-degree felony, trafficking in cocaine, a third-degree felony, possession of cocaine, a third-degree felony, and a forfeiture specification.

According to court documents for the first count, on or around July 8, 2024, Cress knowingly prepared for shipment, shipped, transported, delivered, prepared for distribution or distributed a fentanyl-related compound, a Schedule II controlled substance, in an amount that equals or exceeds 200 unit doses but was less than 500 unit doses or equals or exceeds 20 grams but was less than 50 grams, when Cress knew or had reasonable cause to believe that the controlled substance was intended for sale or resale by the offender or another person.

According to court documents for the second count, on or around July 8, 2024, Cress knowingly obtained, possessed or used a Schedule II controlled substance, to wit: a fentanyl-related compound, a Schedule II controlled substance, in an amount that equals or exceeds 200 unit doses but was less than 500 unit doses or equals or exceeds 20 grams but was less than 50 grams.

According to court documents for the third count, on or around July 8, 2024, Cress knowingly prepared for shipment, shipped, transported, delivered, prepared for distribution or distributed cocaine, a Schedule II controlled substance, in an amount that equals or exceeds 10 grams but was less than 20 grams, when Cress knew or had reasonable cause to believe that the controlled substance was intended for sale or resale by the offender or another person, and Cress having been previously convicted of two or more felony drug abuse offenses.

According to court documents for the fourth count, on or around July 8, 2024, Cress knowingly obtained, possessed or used a Schedule II controlled substance, to wit: cocaine, in an amount that equals or exceeds 10 grams but was less than 20 grams.

According to court documents for the fifth count, the Grand Jurors found and specified that on or around July 8, 2024, Cress had in his possession $22,305 in U.S. currency, with that property subject to forfeiture “due to its instrumentality in the commission or facilitation of the offense.”

In other indictments, Justin Brooks, 34, Greenfield, was indicted on one count of aggravated trafficking in methamphetamine, a third-degree felony, aggravated possession in methamphetamine, a third-degree felony, tampering with evidence, a third-degree felony, and a forfeiture specification.

According to court documents for the first count, on or around Aug. 2, 2024, Brooks knowingly prepared for shipment, shipped, transported, delivered, prepared for distribution or distributed methamphetamine, a Schedule II controlled substance, in an amount that equals or exceeds bulk amount but was less than five times the bulk amount, when Brooks knew or had reasonable cause to believe that the controlled substance was intended for sale or resale by the offender or another person.

According to court documents for the second count, on or around Aug. 2, 2024, Brooks knowingly obtained, possessed or used a Schedule II controlled substance, to wit: methamphetamine, in an amount that equals or exceeds bulk amount but was less than five times the bulk amount.

According to court documents for the third count, on or around Aug. 2, 2024, Brooks, knowing that an official proceeding or investigation was in progress, about to be or likely to be instituted, altered destroyed, concealed or removed any record, document or thing, with the purpose to impair its value or availability as evidence in the proceeding or investigation.

According to court documents for the fourth count, the Grand Jurors found and specified that on or around Aug. 2, 2024, Brooks had in his possession a 1991 Blue Ford Ranger and $94, with the property “subject to forfeiture due to its instrumentality in the commission or facilitation of the offense.”

Stephany Eubanks, 36, Greenfield, was indicted on one count of illegal conveyance of weapons or prohibited items onto the grounds of a detention facility or institution, a third-degree felony, possession of cocaine, a fifth-degree felony, and aggravated possession of methamphetamine, a fifth-degree felony.

According to court documents for the first count, on or around Aug. 2, 2024, Eubanks knowingly conveyed or attempted to convey onto the grounds of a detention facility, to wit: Greenfield Jail, or an institution that was under the control of the department of mental health and addiction services, the department of developmental disabilities, the department of youth services or the department of rehabilitation and correction, a drug of abuse.

According to court documents for the second count, on or around Aug. 2, 2024, Eubanks knowingly obtained, possessed or used a Schedule II controlled substance, to wit: cocaine.

According to court documents for the third count, Eubanks knowingly obtained, possessed or used a Schedule II controlled substance, to wit: methamphetamine.

Joseph Bender, 41, Hillsboro, was indicted on one count of receiving stolen property, a fourth-degree felony, aggravated possession of methamphetamine, a fifth-degree felony, and possession of fentanyl-related compound, a fifth-degree felony.

According to court documents for the first count, on or around Aug. 1, 2024, Bender received, retained or disposed of certain property, that being a 2013 White Ford F250, a motor vehicle, which was the property of another, when Bender knew or had reasonable cause to believe said property has been obtained through the commission of a theft offense.

According to court documents for the second count, Bender knowingly obtained, possessed or used a Schedule II controlled substance, to wit: methamphetamine.

According to court documents for the third count, Bender knowingly obtained, possessed or used a Schedule II controlled substance, to wit: a fentanyl-related compound.

Also indicted on Tuesday were:

*Kevin Daniels, 63, Peebles, for aggravated possession of methamphetamine, a fifth-degree felony.

*Andrew Rackley, 36, Hillsboro, aggravated possession of methamphetamine, a fifth-degree felony.
